TTJA · 2 päeva tagasiVÕS § 411 lg 4 järgi on krediidiandjal juhul, kui ennetähtaegne tagasimaksmine toimub elamukinnisvaraga seotud tarbijakrediidilepingus fikseerimata intressimääraga perioodil, õigus nõuda tarbijalt saamata jäänud intressi kolme järgneva kuu eest. Tarbijalt nõutav hüvitis ei või olla suurem summast, mida tarbija oleks maksnud intressideks ennetähtaegse tagasimaksmise ja tarbijakrediidilepingu lõppemise tähtpäeva vahelisel perioodil (lg 5).
Komisjoni arvates oli tarbija lepingu sõlmimise eelselt olukorras, kus müügitehingu sõlmimata jäämisega kaasnenuks talle olulised negatiivsed tagajärjed. Tarbija oli vaidlustanud kõnealused nõuded juba enne lepingu sõlmimist; seega pidanuks kaupleja jätma vaieldavad nõuded kokkuleppest välja ning soovi korral kaitsma nende põhjendatust eraldiseisvalt. Komisjoni arvates on leping selles osas tühine TsÜS § 86 alusel. Show more
Tühisel tehingul ei ole algusest peale õiguslikku tagajärge; tühise tehingu alusel saadu tuleb VÕS § 1027 alusel tagastada.
