TTJA · 1 päeva tagasiAnaloogselt hagimenetlusega on vaidluste kohtueelne lahendamine põhiolemuselt võistlev menetlus, kus lähtutakse poolte esitatust (vt nt TsMS § 5 lg-d 1 ja 2, § 7, § 230 lg 1). TsMS § 230 lg 1 järgi on poolel kohustus tõendada neid asjaolusid, millele tuginevad tema nõuded ja vastuväited. Poole kohustus on tagada, et ta esitab piisavad tõendid oma nõude rahuldamiseks (Riigikohtu 29. aprill 2015. a otsus tsiviilasjas nr 3-2-1-41-15, p 19). Show more
Avaldaja on esitanud väite, et kaupleja on rikkunud kohustust kontrollida kontonumbri ja saaja nime vastavust. Avaldaja ei ole selgitanud, millest see kaupleja kohustus tuleneb. Avaldaja etteheited kauplejale on arusaadavad, kuid avaldajale ei põhjustanud kahju kaupleja vaid isik, kes viis pettuse läbi. Kaupleja osa kahju tekkimisel ei ole avaldaja esitanud ega tõendanud. Avaldaja etteheited kauplejale on iseloomult ettepanekud selle kohta, kuidas saaks krediidiasutus ja/või riik sarnaste pettuste toimumist piirata kehtestades pankadele kohustusi. Esitatu põhjal ei ole kaupleja kohustust rikkunud (VÕS § 100) ning tarbijal puudub kahju hüvitamise nõue kaupleja vastu (VÕS § 101 lg 1 p 3).

Komisjon nõustub kaupleja selgitustega selles, et laenulepingu täitmiseks tehtavate maksete täielik maksepuhkus toob üldjuhul kaasa põhiosa maksete suurenemise kahel alusel. Kõnealusel juhul oli laenu tagastamise kohustus peatatud kolme kuu kestel. Laenu jääk oli maksepuhkuses kokku leppimise ajal jaotatud graafikusse, mis kestis 158 kuud. Show more
Osalise maksepuhkuse ajal laenu jääk ei vähenenud ja samas summas laenu jääk jaotati maksepuhkuse järgsesse graafikusse, mis kestab 155 kuud. Kuivõrd maksepuhkuse kestel tasumisele kuuluva intress makseks andis kaupleja täiendavat laenu, suurenes tagasimakse suurus ka lisandunud laenusumma tõttu.
