Esitatud materjalidest ei ole võimalik üks ühele teha järeldust, et tarbija ei peaks õppeteenustasu vaidlusaluses summas tasuma.

Show moreArvestades, et õppeteenuslepingu sai lõpetada 30 päevase etteteavitamistähtajaga, siis tuli arvestada ka selle perioodiga. Seega vastavalt lepingule oli tarbija täieõiguslik õpilane kooli õpilaste nimekirjas kuni 07.04.2023. Vastavalt õppelepingule nr TTK 22-22506 p 4.4 on Õpilane kohustatud Lepingu ennetähtaegse lõpetamise korral tasuma kõik Lepingu lõppemise seisuga tekkinud Tasu, viiviste ja muude tasuliste toimingute eest tekkinud võlgnevused, sh maksegraafikuga ajatatud maksed. Tarbijal on kohustus omapoolseid väiteid tõendada.
