Eeltoodud vastuväiteid on Kaupleja tõendanud dokumentaalsete tõenditega. Tekib küsimus, kas pakendisse võis tootja panna ekslikult beeži värvi ortoosi asemele musta värvi ortoosi, mis võis ilmsiks tulla alles pakendi avamisel? Show more
Teoreetiliselt võib selline olukord esineda, kuid tõend kinnitamaks väidet, et Kaupleja müüs 12.11.2021 Tarbijale nimelt musta värvi ortoosi, puudub. Kaupleja on põhjendanud, et ortoose müüvad ka teised apteegid. Seega puudub usaldusväärne tõend, et vaidlusaluse ortoosi müüs Tarbijale nimelt Kaupleja. Seda asjaolu oli võimalik tõendada, esitades foto pakendi avamise kohta. Sellist tõendit ei ole Tarbija esitanud.
