Kaupleja pukseeris Tarbija sõidukit ning Tarbija avalduse kohaselt purunes pukseerimise käigus sõidukil tagasilla viscosidur. Asjale lisatud tõenditest selgus, et viscosiduri purunemise ajal fikseeritud faktilised asjaolud erinesid asjaoludest pukseerimise ajal ning seetõttu ei olnud Kaupleja süü viscosiduri purunemisel tõendatud ja komisjon jättis Tarbija avalduse rahuldamata.
