TTJA · 11 h tagasiTarbija sõlmis kauplejaga müügilepingu, millega soetas söögilaua. Tarbija avalduse kohaselt tekkis pinnale kondensatsiooniveest kahjustus. Kaupleja leidis, et pretensioon ei kuulu rahuldamisele. Show more
Laua plaati ei ole võimalik vahetada kuna kahjustus tekkis kliendi enda süü tõttu. Komisjon leidis, et pole tavapärane, et söögilaud niiskust ei talu. Kaupleja oleks pidanud söögilaua müümisel VÕS § 14-1 p 2 kohaselt tarbija tähelepanu juhtima, et laua sisemised servad on töötlemata ja niiskust ei talu. Komisjon rahuldas avalduse, tunnistas tarbija õigust lepingust taganemiseks ning mõistis VÕS 189 lg 1 alusel söögilaua eest tasutud summa kauplejalt välja.
