TTJA · 18 h tagasiTarbija sõlmis müügilepingu sidevahendi teel, tellis kõrvaklapid ja tasus nende eest. Kaupleja tagastas samal päeval raha teatades, et ei saa lepingut nii madala hinnaga täita, kaupleja tühistas lepingu eksimuse toimumise tõttu. Tarbija sellega ei nõustunud ning esitas kaupleja vastu lepingut täitmise nõude soovides saada kõrvaklappe lepingu sõlmimisel avaldatud hinnaga. Show more
Komisjon nõustus kauplejaga, et antud juhul vabaned kaupleja lepingu täitmise kohustusest. Kaupleja oli kõrvaklappide osas avaldanud ebaõige tootekoodi ja hinna, tagajärjena oli avaldatud hind ligi neli korda odavam. Tegemist on olulise hinnaerinevusega. Kuna kaupleja ei korraldanud kõrvaklappide soodusmüüki, oli tarbijale arusaadav, et avaldatud hind on ekslik ja ei ole tavahind.
