Tarbija on esitanud nõude, et kaupleja hüvitaks eksperdi arvamuse tellimise kulud seoses sellega, et ekspert tuvastaks põhjused, miks esines hoones veeleke. Vaidluste kohtueelsel lahendamisel kohaldub analoogia korras TsMS § 230 lg 1, mille alusel pool peab tõendama asjaolu, millele ta tugineb. Esitatud asjaolude kohaselt on kaupleja lepingut täitnud ja kõrvaldanud elamus esinenud veelekked.

Show moreSamuti on kaupleja pakkunud täiendavat garantiid, et kui veelekked korduvad, kõrvaldab kaupleja need. Esiteks ei ole tarbijal seadusest ega lepingust tulenevat alust kaupleja kulul ekspertiisi tellimiseks. Teiseks, kui lekked on kõrvaldatud, siis ei pruugi isegi juhul, kui selline ekspertiis korraldatakse, olla võimalik juba kõrvaldatud puuduste avastamine. Esitatu kohaselt puudub tarbijal kahjustatud õigus, mille kaitsmiseks tarbija saaks pöörduda tarbijavaidluste komisjoni või kohtusse. Esitatud avaldus on alusetu. Esitatu kohaselt ei ole kaupleja lepingut rikkunud ja tarbija ei saa VÕS § 101 lg 1 sätestatud õiguskaitsevahendeid kasutada.
