TTJA · 12 h tagasiTarbija sõlmis kauplejaga pakettreisilepingu reisiks Hiinasse. Reisil ilmnesid puudused reisiteenustes, tarbija nõudis reisitasu alandamist. Komisjon rahuldas osaliselt tarbija nõude VÕS § 877 lg 2 alusel.

Voucheri järgi pidi Kaupleja tagama tarbijale majutuse perioodil 20.11-03.11.2018, kuid kaupleja väitel sõlmisid pooled üksiku reisiteenuse lepingu, millega tarbija soetas vaid majutusteenuse ning pidi sellega seoses ise veenduma majutuse saadavuses. Pakettreisi raames ei pidanud kaupleja majutust 20.11.2017 reisijatele tagama, mistõttu ei saanud ka tarbija majutust. Komisjon leidis, et pooled sõlmisid pakettreisilepingu (majutus+ ekskursioonid) ning kaupleja rikkus tarbijaga lepingut, et ei taganud tarbijale majutust. Show more
