Tarbija ostis kauplejalt korteri. Pärast korteri ostu on selgunud, et korterelamus on algatatud ulatuslikud renoveerimistööd, mille tõttu tekivad või on juba tekkinud korteris kahjustused. Need asjaolud ei olnud ostu-müügilepingus märgitud ega ostjale ostuhetkel avaldatud.

Show moreKui ostja oleks nendest teadnud, oleks ta saanud hinnata korteri tegelikku seisukorda ja väärtust teisel viisil. Tarbija nõudis kahju hüvitamist.Komisjon leidis, et tegemist ei ole varjatud puudustega VÕS § 218 mõistes. Vastupidi – tegemist on ostetud asja parendamisega korteriühistu poolt. Et ostetud asja parendamine toob endaga kaasa mõningaid ebamugavusi ja kulusid, see on paratamatu ja selle eest ei vastuta müüja. Liiatigi on kaupleja tõendanud, et ta edastas enne ostu-müügi lepingu sõlmimist tarbijale korteriühistu e-kirja, mille manuses olid välja toodud parendustööd, millele tarbija osundab. Seega oli tarbijal võimalus nendega tutvuda ja lepingu sõlmimisest keelduda. Et tarbija seda ei teinud, siis järelikult nõustus ta ostma korteri selle teadmisega, et tal tuleb taluda korteriühistu poolt kavandatud parendustöid. Komisjon jättis tarbija avalduse rahuldamata.
