Komisjon jättis avalduse rahuldamata, kuivõrd tarbija ei teavitanud kauplejat madratsi lepingutingimustele mittevastavusest VÕS § 220 sätestatud tähtajal.Lisaks on tarbija kaupleja teadmata madratsit füüsiliselt muutnud ning madrats ei ole enam kasutamiskõlbulik.
