TTJA · 14 h tagasiVÕS § 186 p 5 kohaselt lõpeb võlasuhe lepingust taganemisega. VÕS § 189 lg 1 sätestab, et lepingust taganemise korral võib kumbki lepingupool nõuda tema poolt lepingu alusel üleantu tagastamist. Kuivõrd Kaupleja ei andnud tooteid kokkulepitud ajal Tarbijale üle, siis on Tarbija lepingust kehtivalt taganenud ning on õigustatud nõudma ostuhinna tagastamist.
VÕS § 186 p 5 kohaselt lõpeb võlasuhe lepingust taganemisega. VÕS § 189 lg 1 sätestab, et lepingust taganemise korral võib kumbki lepingupool nõuda tema poolt lepingu alusel üleantu tagastamist. Kuivõrd Kaupleja ei andnud tooteid kokkulepitud ajal Tarbijale üle, siis on Tarbija lepingust kehtivalt taganenud ning on õigustatud nõudma ostuhinna tagastamist 10,94 euro osas, mille tasumise kohta on dokumentaalne tõend esitatud.
Komisjon leiab, et tarbija nõue on põhjendatud ja kaupleja Medifum Group OÜ peab tarbijale tagastama 93, 55 eurot.
