Tarbija sõlmis kolmeaastase sõiduki garantiikindlustuse lepingu kogumaksega 1752 eurot. Auto müüja OÜ Carcom e-kirjas kasutatud sõnastus „584 eurot / aasta“ võis pealiskaudsel lugemisel olla eksitav, kuid samas kirjas viidati kolmele järjestikusele kuumaksele. Lepingueelsetes dokumentides ja kindlustustunnistusel oli märgitud, et 1752 euro suurune kogumakse tasutakse esimese kolme kuu jooksul kolme 584 euro suuruse maksena.
