Tarbija sõlmis kauplejaga 16.09.2022 lepingu nr 536-262 päikeseelektrijaama paigaldamiseks. Lepingujärgne tööde algus pidi olema 03.10.2022. Tarbija täitis oma lepingujärgse kohustuse tasuda ettemaks.

Kaupleja lubas hiljemalt 2023 aasta esimestel päevadel tarbijale ettemaksu tagastada. Lepingust taganemise avaldus esitati tarbija poolt kauplejale 15.11.2022. Lepingust taganemisel muutub olemasolev võlasuhe tagasitäitmise võlasuhteks (VÕS 10. peatüki 2. jagu). Tarbija tasus kauplejale ettemaksu summas 8340, 60 eurot, mida tal on VÕS § 189 lg 1 alusel õigus tagasi saada.
