Komisjon selgitab, et tellijale saabuvad töövõtulepingu ülesütlemise korral erinevad tagajärjed sõltuvalt sellest, kas ülesütlemise õigust kasutati töövõtja rikkumise tõttu või mitte. Kui tellija on töövõtulepingu üles öelnud töövõtja rikkumise tõttu, on tellijal õigus nõuda ettemaksuna üleantud tasu tagastamist. Kui tellija kasutab ülesütlemise õigust vaid endast sõltuvatel põhjustel, jääb töövõtja tasunõue püsima.

Sellest on võimalik teha tellija kasuks mahaarvamisi üksnes juhul, kui ülesütlemisega kaasneb töövõtja võimalus hoida kokku või kasutada oma tööjõudu muul viisil.
