VÕS § 222 lg 1 kohaselt kui asi ei vasta lepingutingimustele, võib ostja nõuda müüjalt asja parandamist või asendamist, kui valitud õiguskaitsevahendi kasutamine on võimalik ja sellega ei põhjustata müüjale võrreldes teise õiguskaitsevahendiga ebaproportsionaalseid kulusid, arvestades kõiki asjaolusid. Tarbija taotleb valamu asendamist koos paigaldamisega või valamu asendamist ning paigaldamiskulu hüvitamist. Komisjon leiab, et Tarbija nõue on põhjendatud ja kuulub rahuldamisele.
