Kauplejal ei ole tagastäitmissuhtes nõuet, kuivõrd lilleseade väärtusetuks muutumise riisikot kannab kaupleja (VÕS § 190). Tarbija ega ka saaja ei ole kasutu lillekimbu saamisega kaupleja arvel aluseta rikastunud.
Tarbija tellis e-poest lillekimbu. Tellitud kimp ei vastanud tarbija ootustele ning ta soovis saada hüvitist kauba maksumuse ulatuses. Komisjon leidis, et lillekimbud valmivad käsitööna ja võivad olla erinevad, millele on kaupleja ka kodulehel tähelepanu juhtinud. Show more
