Pooltevahelises lepingus välistas kaupleja enda vastutuse juhuks, kui krohvisegu ei sobi. Krohv hakkaski maha kooruma. Tarbija soovis töö parandamist. Komisjon leidis, et kuna töö oli tehtud tarbija soovil tema enda poolt antud krohviretseptiga, kaupleja on tarbijat hoiatanud, et see segu ei pruugi olla sobilik, pooled on lepingus välistanud kaupleja vastutuse, siis ei kuulu tarbija nõue rahuldamisele.
