Autol purunes rehv ning tarbija oli seisukohal, et ta oleks pidanud saama tasuta asendusauto, kuid seda talle ei võimaldatud ehkki enne lepingu sõlmimist kinnitas kaupleja teeninduse tehnik, et sellise kahju hüvitamine on lepinguga kaetud. Kaupleja leidis, et tagatisteenuseleping katab üksnes tootjapoolsete defektide kõrvaldamise ning tagab asendusauto tootjapoolsete defektide korral. Show more
Komisjon leidis, et lepingueelsete läbirääkimiste käigus kinnitas kaupleja, et rehvi purunemise korral on tarbijal õigus asendusautole. Kuna kaupleja ei saanud asendusautot võimaldada, siis oli komisjoni arvates mõistlik, et tarbija kasutas odavaimat võimalust ning mõistis kauplejalt üürisõiduki kulu välja. Nõude sõiduki mitteandise eest jättis komisjon rahuldamata. Komisjon selgitas, et juhul kui kindlustusleping ja tagatisteenuseleping katete osas täiendavad teineteist, siis võib nõude esitada mõlema lepingu alusel. Komisjoni liige Arno Sillat jäi eriarvamusele.
