TTJA · 18 h tagasiKäesoleval juhul on küll tõendatud, et poolte vahel oli sõlmitud tervisehoiuteenuse leping peanaha raviks ja protseduurideks. Tervishoiuteenuse osutamise leping on olemuslikult käsundusleping VÕS § 619 mõttes. (RKo 2-15-123028/39). Praegusel juhul on tarbija tõendanud, et on tasunud ettemaksu teenuse saamiseks, kuid seda ei saanud. Show more
Tarbija ostis vaid kosmeetikatooteid -šampooon ja ampullid. Tarbija on esitanud tõendeid ja väite, et on ka kosmeetikatooted tagastanud. Tarbija on esitanud helifaili, kuid sellest ei ole võimalik tuvastada tegelikke asjaolusid ning toodete tagastamist. Täiendavalt ei ole tuvastatav, kes olid kõnefailis tegelikud pooled. Seega praegusel juhul tuleks tuvastada, kas täiendavad seerumid ja šampoon on tagastatud ning kas need olid kasutamata. Esitatud tõenditest üks ühele järeldust teha ei ole võimalik. Seega rahuldab komisjon üksnes saamata jäänud teenuste osas nõude s.o 933 euro ulatuses (ettemaks 1088 eurot - 155 eurot kosmeetikatooted).
