Komisjon leidis, et tegemist on olulise lepingurikkumisega, kuna Kaupleja ei täitnud lepingut ja tõenäoliselt ei tee seda ka edaspidi. Komisjon otsustas, et Tarbija avaldus tuleb rahuldada VÕS § 116 lg 2 p 1 ja 4 alusel ning Kauplejal tuleb tagastada Tarbijale tasutud raha.
