TTJA · 1 päeva tagasiVÕS § 186 p 5 kohaselt lõpeb võlasuhe lepingust taganemisega. VÕS § 189 lg 1 sätestab, et lepingust taganemise korral võib kumbki lepingupool nõuda tema poolt lepingu alusel üleantu tagastamist. Kuivõrd Kaupleja ei andnud toodet kokkulepitud ajal Tarbijale üle, siis on Tarbija lepingust kehtivalt taganenud ning on õigustatud nõudma ostuhinna tagastamist.
Komisjon leiab, et tarbija nõue on põhjendatud ja kaupleja Tulevikuprojektid MTÜ peab tarbijale tagastama 60,98 eurot.
