VÕS § 186 p 5 kohaselt lõpeb võlasuhe lepingust taganemisega. VÕS § 189 lg 1 sätestab, et lepingust taganemise korral võib kumbki lepingupool nõuda tema poolt lepingu alusel üleantu tagastamist.
