VÕS järgi võib kaupleja tagasimaksega oodata kuni kauba kättesaamiseni või tõendi esitamiseni kauba tagasisaatmise kohta, tarbija on sellised tõendid esitanud, mistõttu ei ole kauplejal alust tagasimaksest keelduda üksnes põhjusel, et kaup väidetavalt ei jõudnud Poola lattu. Kaupleja ei ole menetluse käigus tõendanud, et pakk oleks “kättetoimetamata”. Seega on tarbijal õigus kogusummale. Lepingust taganemisel muutub olemasolev võlasuhe tagasitäitmise võlasuhteks (VÕS 10. peatüki 2. jagu). Komisjon selgitab, et Riigikohus on korduvalt väljendanud seisukohta, et lepingust taganemise kehtivuseks peavad olema täidetud nii selle formaalsed eeldused, eelkõige olema esitatud vastaspoolele õigel ajal taganemisavaldus kui ka sisulised (materiaalsed) eeldused, st taganemiseks peab olema seda õigustav põhjus, eelkõige oluline lepingurikkumine VÕS § 116 mõttes. VÕS § 116 lg 1 kohaselt võib lepingupool lepingust taganeda, kui teine lepingupool on lepingust tulenevat kohustust oluliselt rikkunud. Komisjoni hinnangul on täidetud kõik materiaalsed ja formaalsed eeldused, et lepingust taganeda.
