Tarbija väitel pole ta kaupa kätte saanud. Komisjon leidis, et kuna Kaupleja poolt pandi kaup kokkulepitud e-poe väljastuspunkti ning Tarbijale saadeti kättesaamiseks vajalik PIN kood, tuleb kauba üleandmise kohustus lugeda VÕS § 209 lg 2 alusel täidetuks, mistõttu Tarbija avaldus tuleb jätta rahuldamata.
