VÕS § 220 lg 1 kohaselt ostja peab teatama asja lepingutingimustele mittevastavusest müüjale mõistliku aja jooksul pärast seda, kui ta asja lepingutingimustele mittevastavusest teada sai või pidi teada saama. Tarbijalemüügi puhul peab tarbija teatama asja lepingutingimustele mittevastavusest müüjale kahe kuu jooksul pärast seda, kui ta sai mittevastavusest teada. Tarbija on antud nõude täitnud.

Nimelt VÕS § 222 lg 1 kohaselt kui asi ei vasta lepingutingimustele, võib ostja nõuda müüjalt asja parandamist või asendamist, kui valitud õiguskaitsevahendi kasutamine on võimalik ja sellega ei põhjustata müüjale võrreldes teise õiguskaitsevahendi kasutamisega ebaproportsionaalseid kulusid, arvestades kõiki asjaolusid, muu hulgas väärtust, mis asjal oleks olnud, kui lepingutingimustele mittevastavust ei esineks, lepingutingimustele mittevastavuse olulisust ning ostja võimalust kasutada teist õiguskaitsevahendit ilma märkimisväärse ebamugavuseta.
