Tarbija tellis autole Morocraft hoolduse ning tarbija arvates ei vastanud teenus reklaamile, sest tarbijal purunes väljaspool Eestit süüteküünal, mis murdus ja sattus silindrisse ning tekitas mootoririkke. Tarbija pidi auto transportima kohalikku esindusse ning kandma remondikulusid. Kuna tarbija on kahel korral läbinud Motorcrafti hooldusi, siis oli ta seisukohal,et kaupleja oleks pidanud tema tähelepanu juhtima küünalde vahetamise vajalikkusele ja hoolduse reklaamlause lubab alati korras autot. Kaupleja selgituste kohaselt sisaldab Motorcraft hooldus 12 erinevat operatsiooni, kuid süüteküünalde kontroll nende hulka ei kuulu. Süüteküünladi tavaliselt ei kontrollita, sest nende väljakeeramisel tuleks nad juba asendada, sest nad võivad vigastusi saada.Tarbijal puudusid ka süüteküünalde riketele viitavad kaebused. Komisjon asus seisukohale, et avaldus tuleb jätta rahuldamata. Töövõtuleping ei näinud ette, et kaupleja oleks pidanud teostama süüteküünalde kontrolli või siis asenduse. Komisjoni hinnangul ei ole tegemist eksitamisega, sest Motorcraft hooldus erineb täishooldusest ning selle eesmärgiks ei ole kõikide sõlmede kontrollimine. Samuti ei ole mõeldav, et isegi täishoolduse käigus peaks kaupleja parandama kõik sõiduki vead. VÕS § 635 lg 1
