Tarbija nõudis kauplejalt perioodil august 2022 kuni veebruar 2026 mobiiliarve kaudu tasutud digiteenuse maksete tagastamist summas 166 eurot, leides, et ta sooritas üksnes ühekordse artikli ostu ega soovinud sõlmida automaatselt pikenevat kestvuslepingut. Kaupleja selgitas, et tarbija vormistas veebikeskkonnas püsitellimuse ning teenus oli seotud tarbija telefoninumbri ja e-posti aadressiga. Komisjon leidis, et poolte vahel sõlmiti kestvusleping, kuna tarbija tegi tasulise tehingu ning pooled täitsid lepingut ligikaudu 3,5 aasta jooksul.
